BBC News reports: Pakistan’s tribal region of Waziristan, constantly watched and regularly bombarded by US military drones, has been called the most dangerous place on earth. The relentless assault exacts a huge psychological toll on the people who live there.
The US missile-attacks destroy militant training compounds and cars but they also hit mosques, homes, religious schools and civilian vehicles.
I witnessed the fear, stress and depression this causes for the tribal communities on a visit to the region in May.
The drones do not suddenly appear over the horizon, carry out the attack and leave. At any given time of the day, at least four are hovering in the sky, emitting a distinctive and menacing buzzing sound.
They call them “mosquitoes”.
“Anybody who has been listening to the buzzing all through the day usually can’t sleep at night,” says Abdul Waheed, a tribesman in North Waziristan.
“It’s like a blind man’s stick – it can hit anybody at any time.”
People here tell me that it is not just Taliban and al-Qaeda members who are targeted, many ordinary citizens have been killed as well.
In some cases, tribesmen, motivated by a clan or blood feud, have pointed out a rival as a Taliban member or al-Qaeda sympathiser, they say, in the hope he will be blown to bits.
Everybody believes they could be next.
“There is only one way to sleep now,” says Mateen Khan, a car mechanic in the town of Miranshah. “I take sleeping pills like many other people here. It is either that or stay awake all night.”

Obama risks handing ‘loaded gun’ drone programme to Romney
At the Bureau of Investigative Journalism, Alice K Ross writes: President Obama’s personal involvement in selecting the targets of covert drone strikes means he risks effectively handing a ‘loaded gun’ to Mitt Romney come November, says the co-author of a new report aimed at US policymakers.
‘If Obama leaves, he’s leaving a loaded gun: he’s set up a programme where the greatest constraint is his personal prerogative. There’s no legal oversight, no courtroom that can make [the drone programme] stop. A President Romney could vastly accelerate it,’ said Naureen Shah, associate director of the Counterterrorism and Human Rights Project at the Columbia Law School.
The president ‘personally approves every military target’ in Yemen and Somalia and around a third of targets in Pakistan, the report says. The remainder of strikes in Pakistan are decided by the CIA, so are even further from formal decision-making processes and public scrutiny.
‘We are asking President Obama to put something in writing, to disclose more, because he needs to set up the limitations of the programme before someone else takes control,’ Shah told the Bureau. [Continue reading…]

Stanford International Human Rights and Conflict Resolution Clinic (Stanford Law School) and the Global Justice Clinic (NYU School of Law) have released a new 182-page report, Living Under Drones: Death, injury, and trauma to civilians from U.S. drone practices in Pakistan. Here are the report’s executive summary and recommendations:
In the United States, the dominant narrative about the use of drones in Pakistan is of a surgically precise and effective tool that makes the US safer by enabling “targeted killing” of terrorists, with minimal downsides or collateral impacts.[1]
This narrative is false.
Following nine months of intensive research—including two investigations in Pakistan, more than 130 interviews with victims, witnesses, and experts, and review of thousands of pages of documentation and media reporting—this report presents evidence of the damaging and counterproductive effects of current US drone strike policies. Based on extensive interviews with Pakistanis living in the regions directly affected, as well as humanitarian and medical workers, this report provides new and firsthand testimony about the negative impacts US policies are having on the civilians living under drones.
Real threats to US security and to Pakistani civilians exist in the Pakistani border areas now targeted by drones. It is crucial that the US be able to protect itself from terrorist threats, and that the great harm caused by terrorists to Pakistani civilians be addressed. However, in light of significant evidence of harmful impacts to Pakistani civilians and to US interests, current policies to address terrorism through targeted killings and drone strikes must be carefully re-evaluated.
It is essential that public debate about US policies take the negative effects of current policies into account.
First, while civilian casualties are rarely acknowledged by the US government, there is significant evidence that US drone strikes have injured and killed civilians. In public statements, the US states that there have been “no” or “single digit” civilian casualties.”[2] It is difficult to obtain data on strike casualties because of US efforts to shield the drone program from democratic accountability, compounded by the obstacles to independent investigation of strikes in North Waziristan. The best currently available public aggregate data on drone strikes are provided by The Bureau of Investigative Journalism (TBIJ), an independent journalist organization. TBIJ reports that from June 2004 through mid-September 2012, available data indicate that drone strikes killed 2,562-3,325 people in Pakistan, of whom 474-881 were civilians, including 176 children.[3] TBIJ reports that these strikes also injured an additional 1,228-1,362 individuals. Where media accounts do report civilian casualties, rarely is any information provided about the victims or the communities they leave behind. This report includes the harrowing narratives of many survivors, witnesses, and family members who provided evidence of civilian injuries and deaths in drone strikes to our research team. It also presents detailed accounts of three separate strikes, for which there is evidence of civilian deaths and injuries, including a March 2011 strike on a meeting of tribal elders that killed some 40 individuals.
Second, US drone strike policies cause considerable and under-accounted-for harm to the daily lives of ordinary civilians, beyond death and physical injury. Drones hover twenty-four hours a day over communities in northwest Pakistan, striking homes, vehicles, and public spaces without warning. Their presence terrorizes men, women, and children, giving rise to anxiety and psychological trauma among civilian communities. Those living under drones have to face the constant worry that a deadly strike may be fired at any moment, and the knowledge that they are powerless to protect themselves. These fears have affected behavior. The US practice of striking one area multiple times, and evidence that it has killed rescuers, makes both community members and humanitarian workers afraid or unwilling to assist injured victims. Some community members shy away from gathering in groups, including important tribal dispute-resolution bodies, out of fear that they may attract the attention of drone operators. Some parents choose to keep their children home, and children injured or traumatized by strikes have dropped out of school. Waziris told our researchers that the strikes have undermined cultural and religious practices related to burial, and made family members afraid to attend funerals. In addition, families who lost loved ones or their homes in drone strikes now struggle to support themselves.
Third, publicly available evidence that the strikes have made the US safer overall is ambiguous at best. The strikes have certainly killed alleged combatants and disrupted armed actor networks. However, serious concerns about the efficacy and counter-productive nature of drone strikes have been raised. The number of “high-level” targets killed as a percentage of total casualties is extremely low—estimated at just 2%.[4] Furthermore, evidence suggests that US strikes have facilitated recruitment to violent non-state armed groups, and motivated further violent attacks. As the New York Times has reported, “drones have replaced Guantánamo as the recruiting tool of choice for militants.”[5] Drone strikes have also soured many Pakistanis on cooperation with the US and undermined US-Pakistani relations. One major study shows that 74% of Pakistanis now consider the US an enemy.[6]
Fourth, current US targeted killings and drone strike practices undermine respect for the rule of law and international legal protections and may set dangerous precedents. This report casts doubt on the legality of strikes on individuals or groups not linked to the terrorist attacks of September 11, 2011, and who do not pose imminent threats to the US. The US government’s failure to ensure basic transparency and accountability in its targeted killing policies, to provide necessary details about its targeted killing program, or adequately to set out the legal factors involved in decisions to strike hinders necessary democratic debate about a key aspect of US foreign and national security policy. US practices may also facilitate recourse to lethal force around the globe by establishing dangerous precedents for other governments. As drone manufacturers and officials successfully reduce export control barriers, and as more countries develop lethal drone technologies, these risks increase.
In light of these concerns, this report recommends that the US conduct a fundamental re-evaluation of current targeted killing practices, taking into account all available evidence, the concerns of various stakeholders, and the short and long-term costs and benefits. A significant rethinking of current US targeted killing and drone strike policies is long overdue. US policy-makers, and the American public, cannot continue to ignore evidence of the civilian harm and counter-productive impacts of US targeted killings and drone strikes in Pakistan.
This report also supports and reiterates the calls consistently made by rights groups and others for legality, accountability, and transparency in US drone strike policies:
- The US should fulfill its international obligations with respect to accountability and transparency, and ensure proper democratic debate about key policies. The US should:
- Release the US Department of Justice memoranda outlining the legal basis for US targeted killing in Pakistan;
- Make public critical information concerning US drone strike policies, including as previously and repeatedly requested by various groups and officials:[7] the targeting criteria for so-called “signature” strikes; the mechanisms in place to ensure that targeting complies with international law; which laws are being applied; the nature of investigations into civilian death and injury; and mechanisms in place to track, analyze and publicly recognize civilian casualties;[8]
- Ensure independent investigations into drone strike deaths, consistent with the call made by Ben Emmerson, UN Special Rapporteur on the promotion and protection of human rights and fundamental freedoms while countering terrorism in August 2012;[9]
- In conjunction with robust investigations and, where appropriate, prosecutions, establish compensation programs for civilians harmed by US strikes in Pakistan.
- The US should fulfill its international humanitarian and human rights law obligations with respect to the use of force, including by not using lethal force against individuals who are not members of armed groups with whom the US is in an armed conflict, or otherwise against individuals not posing an imminent threat to life. This includes not double-striking targets as first responders arrive.
- Journalists and media outlets should cease the common practice of referring simply to “militant” deaths, without further explanation. All reporting of government accounts of “militant” deaths should include acknowledgment that the US government counts all adult males killed by strikes as “militants,” absent exonerating evidence. Media accounts relying on anonymous government sources should also highlight the fact of their single-source information and of the past record of false government reports.

Drone warfare seen through an operator’s eyes
James Jeffrey writes: I find myself caught between the need to follow the drone debate and the need to avoid unpleasant memories it stirs. I used drones – unmanned aerial vehicles – during the nadir of my military career that was an operational tour in Afghanistan. I remember cuing up a US Predator strike before deciding the computer screen wasn’t depicting a Taliban insurgent burying an improvised explosive device in the road; rather, a child playing in the dirt.
After returning from Afghanistan at the end of 2009, I left the British army in 2010. I wanted to put as much distance as I could between myself and the UK, leaving to study in America (where I still reside). By doing so, I inadvertently placed myself in the country that is spearheading development in drone technology and use, highlighted by each report of a drone strike and the usual attendant civilian casualties.
Political theorist Hannah Arendt described the history of warfare in the 20th century as the growing incapacity of the army to fulfil its basic function: defending the civilian population. My experiences in Afghanistan brought this issue to a head, leaving me unable to avoid the realization that my role as a soldier had changed, in Arendt’s words, from “that of protector into that of a belated and essentially futile avenger”. Who is held to account for deaths by drone in Yemen?
Chris Woods writes: When news flashed of an air strike on a vehicle in the Yemeni city of Radaa on Sunday afternoon, early claims that al-Qaida militants had died soon gave way to a more grisly reality.
At least 10 civilians had been killed, among them women and children. It was the worst loss of civilian life in Yemen’s brutal internal war since May 2012. Somebody had messed up badly. But was the United States or Yemen responsible?
Local officials and eyewitnesses were clear enough. The Radaa attack was the work of a US drone – a common enough event. Since May 2011, the Bureau of Investigative Journalism has recorded up to 116 US drone strikes in Yemen, part of a broader covert war aimed at crushing Islamist militants. But of those attacks, only 39 have been confirmed by officials as the work of the US.
The attribution of dozens of further possible drone attacks – and others reportedly involving US ships and conventional aircraft – remains unclear. Both the CIA and Pentagon are fighting dirty wars in Yemen, each with a separate arsenal and kill list. Little wonder that hundreds of deaths remain in a limbo of accountability.
With anger rising at the death of civilians in Radaa, Yemen’s government stepped forward to take the blame. It claimed that its own air force had carried out the strike on moving vehicles after receiving “faulty intelligence“. Yet the Yemeni air force is barely fit for purpose.
And why believe the Yemeni defence ministry anyway? Just 48 hours earlier it had made similar claims. But when it emerged that alleged al-Qaida bomber Khaled Musalem Batis had died in a strike, anonymous officials soon admitted that a US drone had carried out that killing. [Continue reading…]
Obama goes on record to lie about drone warfare
Noah Shachtman writes: President Obama doesn’t like to talk about how he uses drones to kill suspected militants — including American citizens. Explanations about who gets picked for remote-control death and who does the picking are left to underlings and aides. Just a few days ago, for example, Obama blew off a local Cincinnati television reporter who asked the president about his “kill list.”
On Wednesday, however, CNN’s Jessica Yellin managed to get Obama to open up, just a little, about his criteria for approving drone attacks. His comments may have been the president’s most extensive so far on robot warfare. They were also total baloney, outside experts say.
As the Bureau of Investigative Journalism notes, Obama told CNN that a terror suspect had to pass five tests before the administration would allow him to be taken out by a drone. “Drones are one tool that we use, and our criteria for using them is very tight and very strict,” the president said.
- “It has to be a target that is authorised by our laws.”
- “It has to be a threat that is serious and not speculative.”
- “It has to be a situation in which we can’t capture the individual before they move forward on some sort of operational plot against the United States.”
- “We’ve got to make sure that in whatever operations we conduct, we are very careful about avoiding civilian casualties.”
- “That while there is a legal justification for us to try and stop [American citizens] from carrying out plots … they are subject to the protections of the Constitution and due process.”
At least two of those five points appear to be half-truths at best. In both Yemen and Pakistan, the CIA is allowed to launch a strike based on the target’s “signature” — that is, whether he appears to look and act like a terrorist. As senior U.S. officials have repeatedly confirmed, intelligence analysts don’t even have to know the target’s name, let alone whether he’s planning to attack the U.S. In some cases, merely being a military-aged male at the wrong place at the wrong time is enough to justify your death.
“What I found most striking was his claim that legitimate targets are a ‘threat that is serious and not speculative,’ and engaged in ‘some operational plot against the United States,’ That is simply not true,” emails the Council on Foreign Relations’ Micah Zenko, who has tracked the drone war as closely as any outside analyst. Hidden history: America’s secret drone war in Africa
David Axe reports: More secret bases. More and better unmanned warplanes. More frequent and deadly robotic attacks. Some five years after a U.S. Predator Unmanned Aerial Vehicle flew the type’s first mission over lawless Somalia, the shadowy American-led drone campaign in the Horn of Africa is targeting Islamic militants more ruthlessly than ever.
Thanks to media accounts, indirect official statements, fragmentary crash reports and one complaint by a U.N. monitoring group, we can finally begin to define — however vaguely — the scope and scale of the secret African drone war.
The details that follow are in part conjecture, albeit informed conjecture. They outline of just one of America’s ongoing shadow wars — and one possible model for the future U.S. way of war. Along with the counterterrorism campaigns in Pakistan, Yemen and the Philippines, the Somalia drone war demonstrates how high-tech U.S. forces can inflict major damage on America’s enemies at relatively low cost … and without most U.S. citizens having any idea it’s even happening.
Since 2007, Predator drones and the larger, more powerful Reapers — reinforced by Ravens and Scan Eagle UAVs and Fire Scout robot helicopters plus a small number of huge, high-flying Global Hawks — have hunted Somali jihadists on scores of occasions. It’s part of a broader campaign of jet bombing runs, naval gun bombardment, cruise-missile attacks, raids by Special Operations Forces and assistance to regional armies such as Uganda’s.
In all, air raids by manned and unmanned U.S. aircraft have killed at least 112 Somali militants, according to a count by the London-based Bureau of Investigative Journalism. Fifty-seven innocent civilians also died in the raids, the nonprofit Bureau found. The dead jihadists have included several senior members of al-Qaeda or the affiliated al-Shabaab extremist group. In January, a drone launched three Hellfire missiles at a convoy near Mogadishu and killed Bilaal al-Barjawi, the mastermind of the 2010 bombing in Kampala, Uganda, that claimed the lives of 74 soccer fans.

Researchers demonstrate how easy it is to hijack a drone
Fox News reports: A small surveillance drone flies over an Austin stadium, diligently following a series of GPS waypoints that have been programmed into its flight computer. By all appearances, the mission is routine.
Suddenly, the drone veers dramatically off course, careering eastward from its intended flight path. A few moments later, it is clear something is seriously wrong as the drone makes a hard right turn, streaking toward the south. Then, as if some phantom has given the drone a self-destruct order, it hurtles toward the ground. Just a few feet from certain catastrophe, a safety pilot with a radio control saves the drone from crashing into the field.
From the sidelines, there are smiles all around over this near-disaster. Professor Todd Humphreys and his team at the University of Texas at Austin’s Radionavigation Laboratory have just completed a successful experiment: illuminating a gaping hole in the government’s plan to open US airspace to thousands of drones.
They could be turned into weapons.
“Spoofing a GPS receiver on a UAV is just another way of hijacking a plane,” Humphreys told Fox News.
In other words, with the right equipment, anyone can take control of a GPS-guided drone and make it do anything they want it to.
“Spoofing” is a relatively new concern in the world of GPS navigation. Until now, the main problem has been GPS jammers, readily available over the Internet, which people use to, for example, hide illicit use of a GPS-tracked company van. It’s also believed Iran brought down that U.S. spy drone last December by jamming its GPS, forcing it into an automatic landing mode after it lost its bearings.
Obama administration clings to ‘secrecy’ of its assassination program
TPM Muckraker reports: In the official view of the Obama administration, it’s totally possible that the drone that killed Anwar al-Awlaki was owned and operated by the Yemen government.
As absurd as it might sound, that’s the possibility the Justice Department is using as one of its justifications for withholding documents related to the targeted killing of U.S. citizens and individuals alleged affiliated with al-Qaeda and other terrorist groups. The justification comes in a briefing filed just before a midnight deadline in response to a lawsuit filed by The New York Times and the American Civil Liberties Union (ACLU) against the government, that alleges they improperly withheld documents in response to Freedom of Information Act requests.
The federal government argues that it has never officially acknowledged the existence of a drone program, claiming that recent public nods by high-ranking administration officials to a targeted killing program do not amount to disclosure about particular operations.
“For example, whether or not the United States government conducted the particular operations that led to the deaths of Anwar al-Aulaki and the other individuals named in the FOIA requests remains classified,” the government writes.
“Likewise, whether or not the CIA has the authority to be, or is in fact, directly involved in targeted lethal operations remains classified. And that is so notwithstanding the unsourced, unofficial statements and media reports that plaintiffs have identified. None of those statements or reports constitutes an official disclosure that could vitiate agencies’ ability to safeguard the classified and other statutorily protected information at issue here, and none eliminates the national security harms that could result from disclosure of such information,” they claim.
Obama administration’s drone death figures don’t add

Last month, a “senior administration official” said the number of civilians killed in drone strikes in Pakistan under President Obama is in the “single digits.” But last year “U.S. officials” said drones in Pakistan killed about 30 civilians in just a yearlong stretch under Obama.
Both claims can’t be true.
A centerpiece of President Obama’s national security strategy, drones strikes in Pakistan are credited by the administration with crippling Al Qaeda but criticized by human rights groups and others for being conducted in secret and killing civilians. The underlying facts are often in dispute and claims about how many people died and who they were vary widely.
So we decided to narrow it down to just one issue: have the administration’s own claims been consistent?
We collected claims by the administration about deaths from drone strikes in Pakistan and compared each one not to local reports but rather to other administration claims. The numbers sometimes do not add up. (Check out our interactive graphic to explore the claims.)
Even setting aside the discrepancy between official and outside estimates of civilian deaths, our analysis shows that the administration’s own figures quoted over the years raise questions about their credibility.
There have been 307 American drone strikes in Pakistan since 2004, according to a New America Foundation count. Just 44 occurred during the Bush administration. President Obama has greatly expanded the use of drones to attack suspected members of Al Qaeda, the Pakistani Taliban, and other groups in Pakistan’s remote northwest region.
Obama officials generally do not comment by name on the drone strikes in Pakistan, but they frequently talk about it to reporters (including us) on condition of anonymity. Often those anonymously sourced comments have come in response to outside tallies of civilian deaths from drone attacks, which are generally much higher than the administration’s own figures.
The outright contradiction we noted above comes from two claims made about a year apart:
* April 22, 2011 McClatchy reports that U.S. officials claim “about 30” civilians died in the year between August 2009 and August 2010.
* May 29, 2012 The New York Times reports that, according to a senior Obama administration official, the number of civilians killed in drone strikes in Pakistan under president Obama is in the “single digits.”
As we also show in our interactive graphic, other anonymous administration claims about civilian deaths are possible but imply conclusions that seem improbable.
Consider:
* April 26, 2010 The Washington Post quotes an “internal CIA accounting” saying that “just over 20 civilians” have been killed by drones in Pakistan since January 2009.
* Aug. 11, 2011 The New York Times reports that CIA officers claim zero civilians were killed since May 2010
* Aug. 12, 2011 CNN quoted a U.S. official saying there were 50 civilians killed over the years in drone strikes in Pakistan.
If this set of claims is assumed to be accurate, it suggests that the majority of the 50 total civilian deaths occurred during the Bush administration 2014 when the drone program was still in its infancy. As we’ve noted, in the entire Bush administration, there were 44 strikes. In the Obama administration through Aug. 12, 2011, there were 222. So according to this set of claims more civilians died in just 44 strikes under Bush than did in 222 strikes under Obama. (Again, the graphic is helpful to assess the administration assertions.)
Consider also these three claims, which imply two lengthy periods when zero or almost zero civilians were killed in drone strikes:
* September 10, 2010 Newsweek quotes a government estimate that “about 30” civilians were killed since the beginning of 2008.
* April 22, 2011 McClatchy reports that U.S. officials claim “about 30” civilians died in the year between August 2009 and August 2010.
* July 15, 2011 Reuters quotes a source familiar with the drone program as saying “about 30” civilians were killed since July 2008.
It’s possible that all these claims are true. But if they are, it implies that the government believes there were zero or almost zero civilian deaths between the beginning of 2008 and August 2009, and then again zero deaths between August 2010 and July 2011. Those periods comprise a total of 182 strikes.
The administration has rejected in the strongest terms outside claims of a high civilian toll from the drone attacks.
Those outside estimates also vary widely. A count by Bill Roggio, editor of the website the Long War Journal, which bases its estimates on news reports, puts the number of civilian killed in Pakistan at 138. The New America Foundation estimates that, based on press reports, between 293 and 471 civilians have been killed in the attacks. The London-based Bureau of Investigative Journalism, which draws on a wider array of sources including researchers and lawyers in Pakistan, puts the number of civilians killed at between 482 and 832. The authors of the various estimates all emphasize that their counts are imperfect.
There are likely multiple reasons for the varying counts of civilian deaths from drone strikes in Pakistan. The attacks are executed remotely in often inaccessible regions. And there’s the question of who U.S. officials are counting as civilians. A story last month in the New York Times reported that President Obama adopted a policy that “in effect counts all military-age males in a strike zone as combatants.”
There are also ongoing debates in the humanitarian law community about who the U.S. may legitimately target with drone strikes and how the CIA is applying the principle of proportionality 2014 which holds that attacks that might cause civilian deaths must be proportional to the level of military advantage anticipated.
In a rare public comment on drone strikes, President Obama told an online town hall in January that the drones had not caused “a huge number of civilian casualties.”
When giving their own figures on civilian deaths, administration officials are often countering local reports. In March 2011, for example, Pakistanis including the country’s army chief accused a U.S. drone strike of hitting a peaceful meeting of tribal elders, killing around 40 people. An unnamed U.S. official rejected the accusations, telling the AP: “There’s every indication that this was a group of terrorists, not a charity car wash in the Pakistani hinterlands.”
Unnamed U.S. officials told the Los Angeles Times last year that “they are confident they know who has been killed because they watch each strike on video and gather intelligence in the aftermath, observing funerals for the dead and eavesdropping on conversations about the strikes.”
U.N. High Commissioner for Human Rights Navi Pillay said during a visit to Pakistan this month that there should be investigation of killings of civilians by drones and that victims should be compensated. The U.S. has given compensation to victims of airstrikes in Afghanistan but there are no reports of victims of drone strikes in Pakistan being compensated.
Since the various administration statements over the years were almost all quoted anonymously, it’s impossible to go back to the officials in question to ask them about contradictions.
Asked about the apparent contradictions, National Security Council spokesman Tommy Vietor told ProPublica: “[W]e simply do not comment on alleged drone strikes.”

Drone strikes threaten 50 years of international law, says UN rapporteur
The Guardian reports: The US policy of using aerial drones to carry out targeted killings presents a major challenge to the system of international law that has endured since the second world war, a United Nations investigator has said.
Christof Heyns, the UN special rapporteur on extrajudicial killings, summary or arbitrary executions, told a conference in Geneva that President Obama’s attacks in Pakistan, Yemen and elsewhere, carried out by the CIA, would encourage other states to flout long-established human rights standards.
In his strongest critique so far of drone strikes, Heyns suggested some may even constitute “war crimes”. His comments come amid rising international unease over the surge in killings by remotely piloted unmanned aerial vehicles (UAVs).
Addressing the conference, which was organised by the American Civil Liberties Union (ACLU), a second UN rapporteur, Ben Emmerson QC, who monitors counter-terrorism, announced he would be prioritising inquiries into drone strikes.
The London-based barrister said the issue was moving rapidly up the international agenda after China and Russia this week jointly issued a statement at the UN Human Rights Council, backed by other countries, condemning drone attacks.
If the US or any other states responsible for attacks outside recognised war zones did not establish independent investigations into each killing, Emmerson emphasised, then “the UN itself should consider establishing an investigatory body”.
U.S. declassifies attacks in Yemen and Somalia
The Associated Press reports: The White House is partially lifting the lid of secrecy on its counterterrorism campaign against al-Qaida in Yemen and Somalia by formally acknowledging for the first time that it is conducting lethal attacks in those countries.
The White House’s semiannual report to Congress on the state of U.S. combat operations abroad, delivered Friday, mentions what has been widely reported for years but never formally acknowledged by the administration: The U.S. military has been taking “direct action” against members of al-Qaida and affiliates in Yemen and Somalia.
The report does not elaborate, but “direct action” is a military term of art that refers to a range of lethal attacks, which in the case of Yemen and Somalia include attacks by armed drones. The report does not mention drones, which are remote-controlled, pilotless aircraft equipped with surveillance cameras and sometimes armed with missiles.
The report applies only to U.S. military operations, including those by special operations forces — not those conducted by the CIA.
“In all cases we are focused on those al-Qaida members and affiliates who pose a direct threat to the United States and to our national interests,” Pentagon press secretary George Little said after the report’s release. “This report contains information about these operations owing to their growing significance in our overall counterterrorism effort.”
The report does not provide details of any military operations in either Yemen or Somalia. It merely acknowledges they have happened. Killings of terror suspects overseas are acknowledged by the administration, but it does not mention the involvement of drones. The CIA and military have separate drone fleets.
U.S. drones deeply unpopular around the world
Glenn Greenwald writes: Last night I wrote about how Obama’s drone attacks and other forms of militarism in the Muslim world are making another Terror attack on U.S. soil more likely, while my Salon colleague Jefferson Morley documented the mass political instability those policies are spawning. A newly released international polling survey from the Pew Research Center sharply underscores both points.
The new multi-nation poll finds that “in predominantly Muslim nations, American anti-terrorism efforts are still widely unpopular.” Beyond Muslim nations, “in nearly all countries, there is considerable opposition to a major component of the Obama administration’s anti-terrorism policy: drone strikes.” Specifically, “in 17 of 20 countries, more than half disapprove of U.S. drone attacks.” As usual, “Americans are the clear outliers on this issue – 62% approve of the drone campaign, including most Republicans (74%), independents (60%) and Democrats (58%).” But in every other surveyed country besides India (which naturally supports any attacks in Pakistan), more people disapprove of Obama’s drone strikes than approve, usually by very wide margins. Indeed, “the policy is unpopular in majority Muslim nations, but also in Europe and other regions as well”; specifically, “at least three-in-four [are opposed] in a diverse set of countries: Greece (90%), Egypt (89%), Jordan (85%), Turkey (81%), Spain (76%), Brazil (76%) and Japan (75%).”
Just as is true in the U.S., Obama — revealingly and unsurprisingly — finds ample support for his policies among the European Right, with substantial opposition on the Left. “A majority (56%) of those who describe themselves as being on the political right in Britain favor U.S. drone strikes against extremists, but just 31% on the left agree.” And “a similar gap emerges in France, where about half of those on the right (49%) approve of the drone attacks, compared with about one-quarter (26%) among people on the left. Obama’s drone wars and the normalisation of extrajudicial murder
Michael Boyle was an adviser on the Obama campaign’s counterterrorism expert group from July 2007-November 2008. He writes: [President Obama] has routinized and normalized extrajudicial killing from the Oval Office, taking advantage of America’s temporary advantage in drone technology to wage a series of shadow wars in Afghanistan, Pakistan, Yemen, and Somalia. Without the scrutiny of the legislature and the courts, and outside the public eye, Obama is authorizing murder on a weekly basis, with a discussion of the guilt or innocence of candidates for the “kill list” being resolved in secret on “Terror Tuesday” teleconferences with administration officials and intelligence officials.
The creation of this “kill list” – as well as the dramatic escalation in drone strikes, which have now killed at least 2,400 people in Pakistan alone, since 2004 – represents a betrayal of President Obama’s promise to make counterterrorism policies consistent with the US constitution. As Charles Pierce has noted, there is nothing in the constitution that allows the president to wage a private war on individuals outside the authorization of Congress.
The spirit of the constitution was quite the opposite: all of the founders were concerned, in varying degrees, with the risk of allowing the president to exercise too much discretion when declaring war or using force abroad. For this reason, the constitution explicitly grants the right to declare war to the Congress in order to restrain the president from chasing enemies around the world based solely on his authority as commander-in-chief. The founders would be horrified, not comforted, to know that the president has implicated himself in the killing of foreign nationals in states against which the Congress has not passed a declaration of war.
