I helped prosecute Watergate. Comey’s statement is sufficient evidence for an obstruction of justice case

Philip Allen Lacovara, a former U.S. deputy solicitor general in the Justice Department who served as counsel to the Watergate special prosecutors, writes: In prepared testimony released on the eve of his appearance Thursday before the Senate Intelligence Committee, former FBI director James B. Comey placed President Trump in the gunsights of a federal criminal investigation, laying out evidence sufficient for a case of obstruction of justice.

Comey proved what Director of National Intelligence Daniel Coats and National Security Agency Director Michael S. Rogers carefully avoided admitting in their testimony on Wednesday — that the president had specifically attempted to shut off at least a major piece of what Trump calls the “Russia thing,” the investigation into the misleading statements by fired national security adviser Michael Flynn concerning his role in dealings with the Russians. This kind of presidential intervention in a pending criminal investigation has not been seen, to my knowledge, since the days of Richard Nixon and Watergate.

Comey’s statement meticulously detailed a series of interventions by Trump soliciting his assistance in getting the criminal probe dropped. These details are red meat for a prosecutor. Presumably, the team of experienced criminal prosecutors that special counsel Robert S. Mueller III has assembled will be following up on this crucial testimony, which rests on contemporaneous memorandums that Comey was sufficiently alarmed to prepare immediately after receiving the president’s requests. Comey’s testimony is the most shocking document about any president since the release of the Watergate tapes

Benjamin Wittes writes: James Comey’s seven-page written statement, released by the Senate Intelligence Committee this afternoon in connection with Comey’s impending testimony tomorrow, draws no conclusions, makes no allegations, and indeed, expresses no opinions. It recounts, in spare and simple prose, a set of facts to which Comey is prepared to testify under oath tomorrow. Despite this sparseness, or maybe I should say because of it, it is the most shocking single document compiled about the official conduct of the public duties of any President since the release of the Watergate tapes.

Let me begin by walking through the document and annotating it a bit with those reasonable inferences that Comey leaves implicit but which a member of Congress, or a member of the public, should certainly consider. That is, let me start by considering in a narrow-bore way what some of these facts mean. Having done so, I’ll zoom out and try to make sense of the big picture as Comey takes the stand tomorrow. Comey proceeds in his statement chronologically. I am going to treat matters more thematically—which will mean bouncing around a bit in the document. James Comey’s written testimony, annotated

In a statement provided to the Senate Select Committee on Intelligence, former FBI Director James Comey writes: The President began by asking me whether I wanted to stay on as FBI Director, which I found strange because he had already told me twice in earlier conversations that he hoped I would stay, and I had assured him that I intended to. He said that lots of people wanted my job and, given the abuse I had taken during the previous year, he would understand if I wanted to walk away.

My instincts told me that the one-on-one setting, and the pretense that this was our first discussion about my position, meant the dinner was, at least in part, an effort to have me ask for my job and create some sort of patronage relationship. That concerned me greatly, given the FBI’s traditionally independent status in the executive branch.

I replied that I loved my work and intended to stay and serve out my ten-year term as Director. And then, because the set-up made me uneasy, I added that I was not “reliable” in the way politicians use that word, but he could always count on me to tell him the truth. I added that I was not on anybody’s side politically and could not be counted on in the traditional political sense, a stance I said was in his best interest as the President.

A few moments later, the President said, “I need loyalty, I expect loyalty.” I didn’t move, speak, or change my facial expression in any way during the awkward silence that followed. We simply looked at each other in silence. The conversation then moved on, but he returned to the subject near the end of our dinner.

At one point, I explained why it was so important that the FBI and the Department of Justice be independent of the White House. I said it was a paradox: Throughout history, some Presidents have decided that because “problems” come from Justice, they should try to hold the Department close. But blurring those boundaries ultimately makes the problems worse by undermining public trust in the institutions and their work.

Near the end of our dinner, the President returned to the subject of my job, saying he was very glad I wanted to stay, adding that he had heard great things about me from Jim Mattis, Jeff Sessions, and many others. He then said, “I need loyalty.” I replied, “You will always get honesty from me.” He paused and then said, “That’s what I want, honest loyalty.” I paused, and then said, “You will get that from me.” As I wrote in the memo I created immediately after the dinner, it is possible we understood the phrase “honest loyalty” differently, but I decided it wouldn’t be productive to push it further. Three senior FBI officials can vouch for Comey’s story about Trump

Murray Waas writes: One by one this winter, then-FBI Director James B. Comey pulled aside three of the bureau’s top officials for private chats. In calm tones, he told each of them about a private Oval Office meeting with President Trump — during which, Comey alleged, the president pressed him to shut down the federal criminal investigation of Trump’s then-national security adviser, Michael Flynn.

Those three officials, according to two people with detailed, firsthand knowledge of the matter, were Jim Rybicki, Comey’s chief of staff and senior counselor; James Baker, the FBI’s general counsel; and Andrew McCabe, then the bureau’s deputy director, and now the acting director, following Trump’s firing of Comey last month. Comey spoke to them within two days of his Oval conversation with Trump, the sources said, and recounted the president’s comments about the Flynn investigation.

The White House and Trump have categorically denied Comey’s account, which Comey reportedly detailed in his own notes shortly after his encounter with Trump. Thus far, the allegation has played as a he-said, she-said between the president and the director he abruptly removed.

That no longer appears to be the case — it will be Trump’s word versus the word of Comey and at least three other leaders of the FBI. [Continue reading…]

Republicans won’t impeach Trump, no matter what his crimes

Jonathan Chait writes: Many conservatives opposed Trump during the primaries because they suspected, with good reason, that his conservatism was shallow or insincere. They worried that, once elected, Trump would abandon their priorities and pursue the most expedient course.

But Trump has not done that at all. The policies or talking points Trump has abandoned are the centrist ones: He would protect Medicaid from cuts, give everybody terrific coverage, hammer the big banks, spend a trillion dollars on infrastructure, and cut deals with both parties. This week, Trump formally abandoned the last possible area of ideological compromise in infrastructure, “clarifying” that his plan relies on private industry, states, or cities ponying up the money. Trump’s budget actually cuts federal investments in infrastructure. He has positioned himself to the right of even House Republicans on domestic spending, and continues to push for their grossly unpopular plan to cut a trillion dollars from Obamacare. “The Never Trump conservative argument that Trump is not a conservative — one that I, too, made repeatedly during the Republican primaries — is not only no longer relevant, it is no longer true,” points out the popular conservative talk-show host Dennis Prager.

Trump is faithfully supporting the conservative agenda, so most conservatives faithfully support him. Their concerns are pragmatic ones about his effectiveness on behalf of their common agenda, rather than moral objections to the legitimacy and propriety of his actions. What Christopher Wray learned from the last two FBI directors

Garrett M Graff writes: With a tweet Wednesday morning, President Trump announced his pick to replace James Comey as FBI director. Should the Senate confirm him, Christopher Wray will step into the job amid the controversial firing of his predecessor, and the appointment of Robert Mueller as special counsel to investigate that incident, as well as the larger swirling questions around Trump and Russia’s meddling with the 2016 election.

It’s no small task. The new FBI director will have to navigate the unique role of the Justice Department and the agency, whose ultimate loyalty is supposed to be to the Constitution, not to any political office-holder. Fortunately for Wray, he’s already seen how that works up close—and learned it at the hands of Comey and Mueller, two of the central figures in today’s political maelstrom.

In early 2004, Wray pulled Comey aside in a hallway of the Justice Department. The executive corridors of stately the building on Pennsylvania Avenue, known to its denizens as “Main Justice,” had been buzzing for days, but most senior leaders—including Wray—didn’t know precisely why. There had been late-night meetings and stressed looks on the faces of their colleagues. Rumors had circulated of a mass resignation of the department’s senior-most leaders, including the FBI director, Robert Mueller.

Wray, then the assistant attorney general in charge of the criminal division—a job that Mueller himself had held 15 years earlier—cornered Comey who, as far as anyone could tell, was the central figure in whatever drama was playing out.

Unbeknownst to any but a select circle, Comey—then the department’s number-two—and Mueller had been facing off with the White House and Vice President Cheney over the constitutionality of an NSA surveillance program known as STELLAR WIND. Comey and the head of Justice Department’s in-house legal advisor, Jack Goldsmith, believed that the program violated the Constitution, and were refusing to approve it.

“Look, I don’t know what’s going on, but before you guys all pull the rip cords, please give me a heads-up so I can jump with you,” said Wray.

It didn’t come to that. Days later, Comey and Mueller voiced their concerns directly to President Bush, who agreed to allow changes to be made to STELLAR WIND. But for Wray, the episode was a signal lesson in the necessary independence, moral compass, and leadership necessary to succeed at the Justice Department.

“[Mueller] has a strong moral compass and I think that the great thing about strong moral compasses is that they don’t have to hand-wring,” Wray told me years later. “When they’re uncomfortable, they know what they have to do.” [Continue reading…]

As ISIS retreats in Syria and attacks Tehran, the U.S. and Iran scramble for control

The Washington Post reports: U.S. and Iran-backed forces are locked in a race to take Islamic State strongholds in southeastern Syria and seize a stretch of land that will either cement Tehran’s regional ambitions, or stifle them.

The scramble for pole position in Deir al-Zour province is likely to be one of the most consequential fights against the extremist group in Syria, posing a regional test for President Trump as his administration turns up the rhetoric against Iran.

While the battle for the Islamic State’s most famous Syrian stronghold of Raqqa is heating up, there are signs that an offensive to seize Deir al-Zour will be tougher, and have greater consequences for the group’s long-term survival as a force holding significant territory.

On the Euphrates River between Raqqa and the Iraqi border, the city of Deir al-Zour is the largest urban center in eastern Syria. Victory for Syrian and Iran-backed forces there would give Tehran control of a large swath of the Syrian-Iraqi border, securing a land route through Iraq and southeast Syria to Damascus in the southwest, and on to its proxy, Hezbollah, in Lebanon. The New York Times reports: At least 12 people were killed and 42 others wounded Wednesday morning in a pair of devastating attacks on two of Iran’s most potent symbols: the national Parliament and the mausoleum of the Islamic Republic’s founder, Ayatollah Ruhollah Khomeini.

The Islamic State immediately claimed responsibility; if that is found to be true, the attacks would be the terrorist group’s first major assault within Iran’s borders. Suspicions in Tehran were also directed at Saudi Arabia, Iran’s nemesis in the region, which has been newly emboldened by a supportive visit from President Trump last month.

In the view of many in Iran, the Islamic State, also known as ISIS or ISIL, is inextricably linked to Saudi Arabia. Hamidreza Taraghi, a hard-line analyst with ties to Iran’s supreme leader, Ayatollah Ali Khamenei, said, “ISIS ideologically, financially and logistically is fully supported and sponsored by Saudi Arabia.”

“They are one and the same,” he added.

The attacks on Wednesday followed a familiar pattern of Islamic State assaults hitting more than one location. Assailants armed with assault rifles and suicide vests descended on the Parliament and on the Khomeini mausoleum. Six attackers were killed: four at the Parliament, and two at the mausoleum. Trump asked intelligence chief if he could pressure Comey to end FBI Russia probe

The Washington Post reports: The nation’s top intelligence official told associates in March that President Trump asked him if he could intervene with then-FBI Director James B. Comey to get the bureau to back off its focus on former national security adviser Michael Flynn in its Russia probe, according to officials.

On March 22, less than a week after being confirmed by the Senate, Director of National Intelligence Daniel Coats attended a briefing at the White House together with officials from several government agencies. As the briefing was wrapping up, Trump asked everyone to leave the room except for Coats and CIA Director Mike Pompeo.

The president then started complaining about the FBI investigation and Comey’s handling of it, said officials familiar with the account Coats gave to associates. Two days earlier, Comey had confirmed in a congressional hearing that the bureau was probing whether Trump’s campaign coordinated with Russia during the 2016 race.

After the encounter, Coats discussed the conversation with other officials and decided that intervening with Comey as Trump had suggested would be inappropriate, according to officials who spoke on condition of anonymity to discuss sensitive internal matters.

The events involving Coats show the president went further than just asking intelligence officials to deny publicly the existence of any evidence showing collusion during the 2016 election, as The Washington Post reported in May. The interaction with Coats indicates that Trump aimed to enlist top officials to have Comey curtail the bureau’s probe. [Continue reading…]

Former DNI Clapper says Watergate ‘pales’ in comparison with Trump Russia scandal

The Guardian reports: The former US director of national intelligence James Clapper says events in Washington now are more serious than the Watergate scandal of the 1970s, and that it is imperative investigators get to the bottom of the Trump administration’s links with the Putin regime.

Clapper used a speech to Australia’s National Press Club on Wednesday to launch a critique of the US president, Donald Trump, describing his decision to cultivate Russia and share intelligence with the Putin regime as “very problematic”. He described Trump’s firing of the FBI chief Jim Comey as “egregious and inexcusable”.

The former intelligence director was asked how current events compared to Watergate and he said the behaviour under scrutiny now was more serious. “I think you compare the two, that Watergate pales, really, in my view, compared to what we’re confronting now.” [Continue reading…]

Sessions is said to have offered to resign

The New York Times reports: Attorney General Jeff Sessions offered to resign in recent weeks as he told President Trump he needed the freedom to do his job, according to two people who were briefed on the discussion.

The president turned down the offer, but on Tuesday, the White House declined to say whether Mr. Trump still had confidence in his attorney general.

“I have not had that discussion with him,” Sean Spicer, the White House press secretary, told reporters, responding to questions about whether the president had soured on Mr. Sessions.

Mr. Spicer’s remarks came after The New York Times reported that Mr. Trump had vented intermittently about Mr. Sessions since the attorney general recused himself from any Russia-related investigations conducted by the Justice Department. Mr. Trump has fumed to allies and advisers ever since, suggesting that Mr. Sessions’s decision was needless. [Continue reading…]

Comey told Sessions: Don’t leave me alone with Trump

The New York Times reports: The day after President Trump asked James B. Comey, the F.B.I. director, to end an investigation into his former national security adviser, Mr. Comey confronted Attorney General Jeff Sessions and said he did not want to be left alone again with the president, according to current and former law enforcement officials.

Mr. Comey believed Mr. Sessions should protect the F.B.I. from White House influence, the officials said, and pulled him aside after a meeting in February to tell him that private interactions between the F.B.I. director and the president were inappropriate. But Mr. Sessions could not guarantee that the president would not try to talk to Mr. Comey alone again, the officials said.

Mr. Comey did not reveal, however, what had so unnerved him about his Oval Office meeting with the president: Mr. Trump’s request that the F.B.I. director end the investigation into the former national security adviser, Michael T. Flynn, who had just been fired. By the time Mr. Trump fired Mr. Comey last month, Mr. Comey had disclosed the meeting to a few of his closest advisers but nobody at the Justice Department, according to the officials, who did not want to be identified discussing Mr. Comey’s interactions with Mr. Trump and Mr. Sessions. U.S. suspects Russian hackers planted fake news behind Qatar crisis

CNN reports: US investigators believe Russian hackers breached Qatar’s state news agency and planted a fake news report that contributed to a crisis among the US’ closest Gulf allies, according to US officials briefed on the investigation.

The FBI recently sent a team of investigators to Doha to help the Qatari government investigate the alleged hacking incident, Qatari and US government officials say.

Intelligence gathered by the US security agencies indicates that Russian hackers were behind the intrusion first reported by the Qatari government two weeks ago, US officials say. Qatar hosts one of the largest US military bases in the region.

The alleged involvement of Russian hackers intensifies concerns by US intelligence and law enforcement agencies that Russia continues to try some of the same cyber-hacking measures on US allies that intelligence agencies believe it used to meddle in the 2016 elections.

US officials say the Russian goal appears to be to cause rifts among the US and its allies. In recent months, suspected Russian cyber activities, including the use of fake news stories, have turned up amid elections in France, Germany and other countries.

It’s not yet clear whether the US has tracked the hackers in the Qatar incident to Russian criminal organizations or to the Russian security services blamed for the US election hacks. Trump tanks his own case at the Supreme Court

Noah Feldman writes: Is Donald Trump trying to throw his own Supreme Court case? The president’s bid to be the Shoeless Joe Jackson of high-court litigation took a big step forward with an astonishing series of early-Monday-morning tweets. He insisted on calling his executive order restricting travel from six majority-Muslim countries a “travel ban,” denounced his own Department of Justice for watering down the original order, and — incredibly — called for strengthening the ban, presumably after the court has upheld the revised order.

All four tweets will be quoted by opponents of the travel ban. All four substantially strengthen the case for blocking the order as unconstitutional. Taken together, they amount to a nightmare scenario for the office of the solicitor general that must represent the president in court. Short of actually saying that the point of the order was to express anti-Muslim animus, there’s not much Trump could have done to weaken his case more. [Continue reading…]

Senior diplomat in Beijing embassy resigns over Trump’s climate change decision

The Washington Post reports: The No. 2 diplomat at the U.S. Embassy in Beijing resigned Monday, telling staff his conscience would not permit him to formally notify the Chinese that the United States is withdrawing from the Paris climate accord.

David H. Rank, a career Foreign Service officer of 27 years, had been acting ambassador until former Iowa governor Terry Branstad (R) was confirmed as the new ambassador last month. Rank held a town meeting with embassy employees to explain he had offered his resignation and it had been accepted.

As the head of the embassy until Branstad arrives, it was Rank’s responsibility to deliver a formal notification of the U.S. intention to withdraw from the climate pact.

According to a State Department official, who spoke on the condition of anonymity to be more candid, Rank was unwilling to deliver the demarche.

He told his staff that as “a parent, a patriot and a Christian,” he could not in good conscience play a role in implementing President Trump’s decision to withdraw, according to a colleague familiar with Rank’s comments. [Continue reading…]

The flake in the Oval Office: For Trump ‘two weeks’ means: who knows when?

Bloomberg reports: President Donald Trump has a plan. It’ll be ready in two weeks.

From overhauling the tax code to releasing an infrastructure package to making decisions on Nafta and the Paris climate agreement, Trump has a common refrain: A big announcement is coming in just “two weeks.” It rarely does.

On Feb. 9, Trump boasted that his administration was “way ahead of schedule” on a tax overhaul.

“We’re going to be announcing something I would say over the next two or three weeks that will be phenomenal in terms of tax and developing our aviation infrastructure,” Trump said while meeting with airline executives.

Eleven weeks elapsed before the White House released a one-page outline of the tax plan. [Continue reading…]

Politico reports: President Donald Trump is lashing out at Democrats for allegedly stalling his appointments and agenda, but it’s his own administration that is frequently sitting on the necessary paperwork for nominees.

Trump tapped Kevin McAleenan on March 30 to lead Customs and Border Protection, a critical position for his drive to revamp U.S. immigration policy. But the White House didn’t formally submit his nomination to the Senate for confirmation until May 22, nearly eight weeks later.

And McAleenan’s nomination is far from alone in taking weeks to be sent to the Senate, where Republicans are growing impatient and bewildered with the Trump White House’s historic lag in filling administration posts.

Trump’s two nominees for the Export-Import Bank board — ex-GOP Reps. Scott Garrett and Spencer Bachus — haven’t been submitted to the Senate, despite being named April 14. Trump rolled out a batch of 10 judicial nominations to much fanfare on May 8, but two of them have yet to arrive on Capitol Hill.

And Dan Brouillette, nominated by Trump to be Rick Perry’s chief deputy at the Energy Department, was announced on April 3, yet his nomination wasn’t sent by the White House until May 16. [Continue reading…]

Trump doubles down on original ‘TRAVEL BAN!’

The New York Times reports: President Trump rebelled on Monday against his own advisers who “watered down” his original executive order barring visitors from select Muslim-majority countries from entering the United States and who insisted on calling it something other than a travel ban.

Returning to one of the issues that animated the early days of his presidency and generated a court battle that has now gone to the Supreme Court, Mr. Trump argued that it was a mistake to revise the first order he signed and suggested that his administration should return to a “much tougher version.”

In a series of Twitter posts just two days after a terrorist attack killed at least seven people in London, Mr. Trump seemed to reject everything his own administration has done to win court approval for restrictions on entry from countries that he designated, both in terms of vocabulary and in terms of its provisions.

“People, the lawyers and the courts can call it whatever they want, but I am calling it what we need and what it is, a TRAVEL BAN!” he wrote. [Continue reading…]

The problem with Jared Kushner

An editorial in the New York Times says: What are we supposed to make of the news that Jared Kushner, President Trump’s son-in-law and senior White House adviser, met with the Russian ambassador in December to discuss establishing a back channel between the incoming Trump administration and the Kremlin, using Russian diplomatic facilities?

Start with the reactions from America’s intelligence community, whose job it is to monitor foreign actors’ attempts to steal the nation’s most closely guarded secrets.

Michael Hayden, the former C.I.A. director, said this: “What manner of ignorance, chaos, hubris, suspicion, contempt would you have to have to think that doing this with the Russian ambassador was a good or an appropriate idea?” Another former top intelligence official called it “extremely naïve or absolutely crazy.”

Mr. Kushner is now under scrutiny by F.B.I. investigators looking into whether the Trump campaign colluded with Russian officials to influence the outcome of the 2016 presidential election.

Stupidity, paranoia, malevolence — it’s hard to distinguish among competing explanations for the behavior of people in this administration. In the case of Mr. Kushner’s meeting with Sergey Kislyak, the ambassador, and his meeting that month with Sergey Gorkov, a Russian banker with close ties to the Kremlin and Russian intelligence, even the most benign of the various working theories suggests that Mr. Kushner, who had no experience in politics or diplomacy before Mr. Trump’s campaign, is in way over his head.
